The Agreement and Definitions
1.1 The agreement is between Wolsey Hall and the educational organisation or institution (hereafter referred to as the “school” or “you”) who acts on behalf of the parents or guardians of the students of their school. The school will appoint a Flexible Learning Coordinator (FLC) to carry out the role as outlined in the accompanying document.
1.2 You are not a representative or agent of Wolsey Hall and these terms may not be used to represent yourself to prospective or existing students.
1.3 We agree to sell, and you agree to buy the Course on the terms and conditions set out below.
1.4 “Course” means the course for which your student is enrolled including all related learning materials and support.
1.5 The “Period” of the Course is the time over which the course is provided. This depends on the nominated Access Date for your student’s course(s) and, if it is an examination course, the date you select for the examination. The maximum Period for Primary, Lower Secondary or AS courses is one year from the Access Date, and for IGCSE or A level courses it is two years from the Access Date, subject to clause 7 below. The Access Date is shown on your Statement of Enrolment and may not be modified once the Access Date has passed.
1.6 When a course period ends, the Course is concluded. Your student will have access to course materials for a further period of one month, during which they can save assignments and tutor feedback. After this time, your student will no longer be able to access the Course.
1.7 We reserve the right to require your students to take Wolsey Hall’s internal pre-assessments before enrolling onto our Courses
1.8 We reserve the right to refuse enrolment of your students onto our Courses.
2. Fees and payment
2.1 Course fees include the cost of postage for any necessary physical textbooks to be sent within, but not outside, the UK. Postal charges, which differ from country to country, will be quoted by our Admissions team if you are outside the UK. Coursebooks for all students whom you are enrolling onto our courses will be sent to your school address in one consignment wherever possible. Separate postage of coursebooks to the students’ home addresses is not available.
2.2 The fees shown do not include the cost of examinations. Examination fees are payable to your chosen exam centre if you are not already an authorised exam centre.
2.3 A credit note for the value of the relevant course fees (less any registration fee and the cost of course books) will be issued if you email us within 14 calendar days of the course Access Date as shown on the student’s Statement of Enrolment, stating that you wish the course to be cancelled. Please note that Wolsey Hall reserves the right to refuse to issue a credit note if significant course content has been downloaded during the 14-day period.
2.4 A credit note is valid for up to 12 months from the date of issue.
2.5 Fee quotes provided by Wolsey Hall are valid for 30 days.
2.6 Fees are reviewed on an annual basis in the first quarter of the calendar year. Any fee changes will be applicable for new courses for which payment is received after 31 March of the same calendar year.
2.7 We cannot accept payment for a course more than three months before the Access Date.
2.8 Additional fees and charges may be payable as outlined in section 7.
3. Services provided
3.1 During the period of your student’s Course, we will provide your student with support and tuition as described in the accompanying ‘How the Wolsey Hall System Works for Schools’ document.
3.2 If we agree to issue a credit note for course fees for a cancelled course, the credit note will also cover the cost of any ancillary service relating to that specific course, provided that no part of that service has been delivered at the date of cancellation. Otherwise, no credit note or refund is available for cancelled ancillary services.
4. Marketing and Promotion of Wolsey Hall courses
4.1 You must gain approval from us before printing or publishing any material using the Wolsey Hall name or logo. In return we will seek consent to use your school’s name and logo on our printed and published material.
4.2 If the agreement between you and Wolsey Hall is terminated, you must remove the Wolsey Hall name or logo from all of your material and you must no longer promote your relationship with Wolsey Hall.
5. Examinations and Results
5.1 If your student is sitting an examination at the end of their Course and your site of learning is not an authorised Cambridge or Edexcel (as appropriate) exam centre, you will be responsible for making timely arrangements with an external exam centre where your student can sit their examinations, and for the payment of the examination fees. Please be guided by your chosen exam centre’s deadlines for sitting the examinations.
5.2 Where your student is required to sit any of their examinations at an external exam centre we strongly advise you to make sure your student will have access to an exam centre BEFORE enrolling them on a course. We cannot make examination arrangements for you, but our Admissions team will be pleased to advise you on how to proceed during the Admissions stage.
5.3 You are also fully responsible for ensuring any access arrangements are in place and approved by the examining board where required for any of your students. These include, for example, extra time or a reader in the examination, or special consideration where a student has a disability or cannot leave their home to take their examination.
5.4 If your student is taking an examination course, you agree to advise us of the examination results as soon as these become available. The examination results that you share with us will be for Wolsey Hall’s internal use only.
5.5 We provide a Mock Exam Marking and Feedback Service for all IGCSE and A Level courses. This is available from Spring Term each year and uses the most recent exam papers available. Your student must submit Mock Exam papers for marking at least two weeks before the external examination. Mock Exams are marked by tutors within five days of submission, with constructive and detailed feedback.
6. Change of Course
6.1 If your student wishes to transfer to a different course this must be done within the first three months of the Access Date to the paid-for course.
6.2 In this event, any fees received for the portion of the course not being taken by the student will be transferred towards the cost of the new course, less an administration fee and cost of new books.
7a(i) Extending a non-exam course
Should your student wish to extend the end date of their non-exam Course, you may arrange to do so by contacting your School Progress Supervisor. Access to non-exam Courses is for a 12-month period from the Access Date but it is recognised there may be a need to extend access to a Course if your student has not completed the course in the time available. There will be a course extension fee which is charged per student (provided that all of that student’s Courses are extended to the same date), which will provide access to a Course for a further six months. Please note that a request for extension should be made before the agreed course end date; an extension request received more than one month after the course end date will be declined.
7a(ii) Deferring an exam date or extending an exam course
An exam deferral is the term used when a student is deferring the exam date of a Course by one or more exam sittings, whilst not extending the term of their Course past the duration described in point 1.4. Should a student of yours wish to defer a Course to a later exam date than that for which they originally enrolled, you may arrange to do so by contacting your Schools Progress Supervisor. There will be no charge for deferring the exam date provided this does not go beyond the Course ‘period’ as described in point 1.4, unless the student needs to take a revised course and/or requires different books. In this instance, you will bear any additional costs (“additional charges”).
A course extension is the term used when a student is changing their exam date and extending the term of their Course past the duration described in point 1.4. Students who wish to extend their Courses in this way are able to do this on payment of an administration fee based on the number of courses being deferred, plus additional charges as detailed above.
If subsequent course deferrals and/or extensions are sought, we will assess them on a case-by-case basis. We reserve the right to not grant a deferral or extension request.
7b Dormancy of course(s) and inactive students
We reserve the right to withdraw a student’s access to Courses on which they are enrolled if they do not engage with the Course or submit assignments. Any concerns regarding inactive students will be raised in the first instance by your School Progress Supervisor, to be addressed by the school directly with the student concerned.
8. Local requirements
As local regulations vary from country to country, you as the school are responsible for ensuring that enrolling on our online courses is permitted and recognised in the student’s location.
9. Warranties and limitation of liability
9.1 We warrant that our learning materials will be of good quality.
9.2 We warrant that we will provide your student with all services with reasonable skill and care.
9.3 We shall not be liable for injury to anyone or for any damage caused during practical science experiments performed at home, your site of learning or elsewhere. No harmful or toxic substances are required for any of the practical work on our science courses and schools are responsible for ensuring the safety of the environment in which their student is working.
9.4 We shall not be liable for: (a) losses that were unforeseeable by both parties when this Agreement was made; (b) losses that were not caused by any breach on our part.
9.5 Our liability for direct losses arising out of our negligence, breach of contract or any other cause of action in connection with this Agreement shall be limited to the total amount that you have paid for the Course.
9.6 Whilst every effort is made to ensure that all downloadable files are virus free, we cannot be held liable for systems problems due to viruses. We strongly recommend that you install all necessary virus protection software before your student commences their course, and keep it regularly updated.
9.7 We cannot be held responsible for any changes made to third party website or video links which are used in some of the Course materials; such changes are the responsibility of the third party.
10. Course Suspension
Wolsey Hall reserves the right to suspend a student’s access to their Course(s) for inappropriate behaviour or where it deems that continuation would no longer be in the student’s interest.
11. IT browser requirements
Our online learning platform works best with the latest versions of Chrome. It does not support Internet Explorer.
12. Copyright
All course materials are Wolsey Hall copyright and supplied solely for the use of the student who is taking the Course. By applying for a Course, you agree that the Course material will not be used for any other purposes.
13. Content, Logins and Subscriptions
All logins to the Wolsey Hall services, including Canvas, as well as any logins provided for external websites and subscriptions, are for the sole use of the registered Wolsey Hall student, and must not be shared with others. The sharing of Wolsey Hall logins, subscriptions and course content with others is not permitted and would be deemed to be a breach of our terms and conditions.
